Terms & Conditions
When
buying goods and services on the Internet, you, the consumer
are entering a legally binding contract. The
following Terms and Conditions are
set in accordance with UK Trading Standards, the UK law
being the applicable law. We are required to inform you
that all sales transactions on this web-site are governed
by English law and you must
agree to submit any dispute to the non-exclusive jurisdiction
of the English courts. All orders are subject to these terms
and conditions and no amendments will be accepted by us.
These terms and conditions do not affect your legal rights.
Pricing & Payment
All prices are in £ sterling inclusive of VAT. Delivery charges refer
to delivery to UK Mainland delivery (please phone for delivery
pricing to Northern Ireland, Isle of Man & Channel Islands and for International
destinations.
We accept all major credit & debit
cards, but not American Express. All offers and products
are subject to availability.
In the event of an item being out of stock
with either ourselves or our suppliers, we will not process
your payment and reserve
our right as a retailer not to accept your offer to buy the goods. If this
is the case, then we will inform you accordingly. Occasionally,
for stock\availability reasons, we may substitute an item
displayed for another item of equal or greater value. If
you are not satisfied with the substitute item, you must
return the item immediately in a complete, unused and in
'as new' condition. If you have opened the box to examine
the product you must have done so without marking or damaging
the product in anyway. The cost of returning unsatisfactory
substitute goods will be refunded to you upon satisfactory
receipt of the item.
Returns
You can cancel your order at anytime either before or up
to 7 days after delivery of your product. You must inform
us about your cancellation in writing
(not by telephone) either by writing to us at The Vintage
DrumYard, Unit 8.Anchor Rd Ind Est, Clacton-on-sea, Essex
CO15 1HP or email info@vintagedrumyard.co.uk.
You can return the product to us in person
by visiting us or by post. You must provide proof of purchase.
Ideally, this should be your original
receipt but it can be a credit card voucher or cheque stub
or anything that indicates when the item was
purchased
from The Vintage
DrumYard. Your product must
be in a complete and unused state without any marks. The
item should be returned with the original
box,
packing and accessories.
Any extra “freebies” received
with the product (such as when we throw in a pair of sticks
etc free of charge)
must also be returned. You (the customer)
must bear all costs incurred in returning the item to
the Vintage DrumYard.
We will not cancel your purchase when:
You return your product without proof of purchase.
The goods were a special \ custom order to your exacting
requirements.
If a problem occurs with a product and you believe the
product to be deemed as “faulty”, we will deal with the
situation as quickly as possible and endeavour to provide
a swift resolution. With the exception of “consumable” items
(drumsticks, drum skins, guitar strings), most goods have
a 12 month manufacturers guarantee against faulty materials,
defects or workmanship. As a consumer, your statutory rights
mean that you have the right to pursue a problem with faulty
goods with us (the retailer) and \ or the manufacturer. If
we are unable to provide you with an exchange or replacement
(i.e. discontinued item or out of stock with supplier) and
you do not wish to receive a refund, we will offer to pursue
the manufacturer on your behalf in order to rectify the problem
with the product. In order to qualify for a refund or exchange,
the product must be accompanied by proof of purchase.
This guarantee does not cover consumable items (eg drum-sticks,
heads, strings etc) faults caused by accident, neglect, misuse
or normal wear and tear, unless there isvisible evidence
of manufacturing fault.
THIS RETURNS POLICY DOES NOT AFFECT YOUR STATUTORY RIGHTS.
Dispatch and Delivery
Depending on weight, we will send out goods either by Royal
Mail Standard 1st or 2nd Class Recorded delivery, or by
48 hour insured courier. At the time of writing, we use
ParcelForce.
For orders placed by 1pm Monday - Friday,
we will endeavour to dispatch the same day. For orders placed
after 1pm Friday,
or at any time on Saturday, goods will
be dispatched the following Monday (not including Bank Holidays).
Delivery should take no more than
two working days (i.e. Monday -Friday). Deliveries do not take place on Saturdays
or Sundays. If goods are not received within the described
timescale, please telephone us. Courier deliveries will require
a recipient’s signature. If the courier cannot get
a reply from the address you have requested us to send to,
they will leave a card in the letterbox indicating that they
have tried to deliver, which will also contain instructions
to phone their local depot to indicate a suitable day for
delivery, or inviting you to collect the package yourself
from your local depot. If they do not hear from you, they
will try a further three (3) attempts to make delivery. If
they still fail to get an answer, your parcel will be returned
to us and you will incur an additional charge for re-delivery.
On occasion, it has been known for some customers to request
that we instruct the courier to leave their parcel outside
an address without obtaining a signature. In this scenario,
The Vintage
DrumYard and the courier they have engaged to deliver the
item(s) will not be held responsible for any losses or damage
to the item(s) left without a receipt signature. This is
done entirely at the customers own risk!
Data Protection & Security
Your
orders are held on a secure server the security of which
meets the stringent requirements of our payment processors.
We do not file records of customer’s credit cards
for future use.
We do not pass on customer’s information to third
parties.
We “black out” and make every reasonable effort
to destroy credit card information that is contained on
receipts dispatched with customers orders.
These terms and conditions do not affect your legal rights.
We are required by law to tell you that sales can be concluded
in English & that we do not file copies of customer
contracts.
